I read this in an article today:
"Microsoft previously argued that it isn’t a monopoly and shouldn’t be subject to any restrictions on its conduct. But it is changing its tone as settlement talks continue in Chicago and both sides prepare to return to federal court here for closing arguments next week.
'Microsoft is quite seriously trying to settle this case, and we believe a common-sense settlement should be possible,' Microsoft wrote in an e-mail to congressional offices."
Is this a sign that microsoft is a bit scared of what might happen... or are they admitting fault in their practices? Its probably more lawyerly posturing than anything else, but its a change from what they had been saying.

From Upside:
After talking up the virtues of Linux and predicting slow sales of Microsoft's Windows 2000 in a conference call last week, the Dell CEO put it all on the line for Microsoft's server OS at the Windows 2000 conference Tuesday. Dell.com -- a $40 million-a-day site responsible for 50 percent of Dell's revenue -- has been moved over to Windows 2000, he said. He also predicted that the OS, with Dell's help, will "further encroach on the Unix market."

This probably isn't anything to be worried about. These research firms like to scare companies into buying their research, so they make announcements like the local news ("What common food has been found to cause cancer? We'll tell you at 11.") If there really are compatibility issues, Microsoft will have them resolved within a few weeks.

The European Union announced a surprise antitrust probe into the potentially illegal bundling of server software with the Windows 2000 operating system by Microsoft, after previously indicating it would go along with the findings of the Justice Department's investigation into the company.

Steve Ballmer will be a very different CEO for Microsoft than Bill Gates was, but don't expect the software giant's winning ways to change.

According to sources familiar with the discussions, little progress has been made toward a settlement between Microsoft and the Department of Justice, and it's unlikely that mediation will yield an agreement.

Its certainly continuing to dip, off nearly 7% today after what certainly wasn't a bad earnings report. Is the drop related to the court proceedings at all? Or to Ballmer taking over for Gates?
I kind of agree with Bill that it might be a good time to buy. The looming DOJ case is what keeps me from doing so...

Any opinions on how Ballmer will do as CEO?

I was happy with the earnings number, but I was looking for $6.4 billion in revenues... the actual number was only 18% above the same quarter last year. But I've learned to stop worrying about the quarterly numbers with Microsoft, and just buy on dips (like today) and hang on for the ride.

Good call, lockin! Right on the money.
47 cents EPS
$6.1 billion revenues
52% margins
Great numbers, as always.
